Warranty liability and procedures for lodging a complaint


§ 1

Warranty of Wilk Elektronik S.A.

Wilk Elektronik S.A. promises the purchaser that everything has been done to ensure that products covered by the guarantee will be free from defects and flaws in their materials and workmanship during the whole period of their use.


§ 2

Procedures for submitting complaints

Warranty is offered to direct purchasers and may not be transferred. Any claims related to products that do not fulfil the conditions of this guarantee can be submitted only by customers who purchased the given product directly from Wilk Elektronik S.A.


1. A memory module to be serviced by Wilk Elektronik S.A., must be delivered either in person or by courier (forwarding agent):

1.1 In cases where a complaint is submitted via courier– it is the customer who bears the cost.

2. In order to have a memory product accepted for service that is delivered by the means defined in Point 1, the following terms must be fulfilled:

a copy of the purchase invoice must be delivered,

the warranty seals must not be damaged,

the device must be delivered complete (flash type memory products – e.g. USB drive, etc.),

any labels or markings made on the module by the purchaser must be removed.

2.1 and additionally - in the case of submitting a product for servicing by means of a courier (forwarding agent):

anti-static packaging must be used,

the notification must be registered in the ‘online service’ and a print-out of the notification must be attached to the shipment.

3. In cases where a memory product that is the subject of a complaint is delivered in person, a receipt will be issued, confirming that the product has been accepted for service.

4. Wilk Elektronik S.A. warns that:

4.1 It will not issue a copy of the above-mentioned receipt.

4.2. It is not liable for any outcome of the loss of the above-mentioned receipt.

5. In cases where the product for servicing is delivered by courier (forwarding agent) the acceptance of the shipment is confirmed by signature and the company stamp affixed to the bill of lading by an employee of Wilk Elektronik S.A..

5.1. At the same time, Wilk Elektronik S.A. reserves for itself the right to withdraw a memory product that has been the subject of a complaint, from servicing and return it to the purchaser at the latter’s expense, if:

the purchaser has not met the conditions outlined in Point 2,

the state of the shipment departs from that described in the attached documents,

the shipment contains goods not purchased directly from Wilk Elektronik S.A.

5.2. The withdrawal of goods, as referred to in Point 5.1, and the explanation of possible inconsistencies, should take place within two working days from the date of receipt of the shipment.

5.3. Within the same period of two working days the Purchaser may submit reservations as to the state of the goods returned to him or her by Wilk Elektronik S.A.. The two-day period is counted from the date of receipt of the goods (the signing of the bill of lading by the Purchaser).

5.4. If no reservations, as mentioned in Points 5.1. and 5.2., are submitted, it means that the state of the consignment has been accepted and the rights from Points 5.1 - 5.3 have been waived.

6. Service time limits:

Wilk Elektronik S.A. is obliged to repair a memory product submitted within the scope of a complaint procedure within 7 working days, calculated from the date of receipt.

7. Procedure for releasing goods from service:

7.1. In order to receive a memory product in person from the service department, it is necessary to present the original of the receipt, confirming that it was accepted.

7.2. The cost of returning a memory product received by the service department to the address of the Purchaser by means of a courier (forwarding agent) is borne by Wilk Elektronik S.A..


§ 3

Loss of warranty rights

1. Warranty rights are lost in cases where:

1.1. The warranty seals of Wilk Elektronik S.A. have been removed or damaged.

1.2. Repairs have been carried out by unauthorized persons, i.e. non-employees of Wilk Elektronik S.A.

1.3. Mechanical, chemical, thermal or electrical damage to the memory module has occurred, including that caused as a result of a computer breakdown or power cut, whether deliberate or accidental.

1.4. Damage has been caused as a result of use, storage or installation that is inappropriate or incompliant with the user guide.


ATTENTION!!!

Products sold by WILK ELEKTRONIK S.A. are not intended for use as ‘critical components’ in ‘life support devices or systems’ or other ‘critical applications’.


Life support devices or systems are understood as systems, which are used for supporting and maintaining life functions, and whose failure can lead to considerable injury to the user. ‘Critical components’ are such that damage to them can entail a failure of devices or systems used for supporting life or a decrease in their security or effectiveness. ‘Critical applications’ are understood as applications that entail a potential risk of death, injury or serious loss of property, or damage to the natural environment.


The stipulations of the Civil Code are applicable in all issues not covered by these regulations.
